TERMS AND CONDITIONS OF THE SAMSUNG S.T.A.R LOYALTY PROGRAM

1.        Samsung Gulf Electronics FZE, a company organized and existing under the laws of the United Arab Emirates with Commercial Registration No. 126 having its principal place of business at R/A-05, Plot no. B34BR07, P.O.Box-61247, Jebel Ali Free Zone, Dubai, United Arab Emirates, (hereinafter referred to as the “Samsung" or “we” or “us”; and references to “you” or “member” shall mean you, the member of the Samsung S.T.A.R Loyalty Program.

2.        We have referred to these terms and conditions as the “Terms” throughout this document.

3.        These Terms govern: your membership of the Samsung S.T.A.R (“Program”) and how Samsung S.T.A.R Points (“Points”) and Samsung S.T.A.R Cash or Non Cash Rewards (“Rewards”) are collected and used. In all circumstances by signing the application form, you agree to be bound by and comply with the Terms. The Program is open to any store owner or store’s shareholder where Samsung mobile Phones are sold. We reserve the right to refuse or withdraw membership where we reasonably believe, at our sole discretion.

4.        Samsung mobiles phones sales will be regarded as qualified only when the Samsung phones are bought from our official distributors in your country.

5.        You must present your valid identity at the time of (1) Joining as a member of Samsung S.T.A.R (2) Receiving cash from Samsung, redeemed against the Points under the Program; and (3) redeeming any Samsung non cash rewards against the Points under the Program.

6.        Under the Program we will award you Points to be earned on (1) Selling qualifying Samsung mobile Phones sales made at any of your store to the end customers. (2) Upon every sale of a qualifying Samsung mobile phone sales, the respective IMEI ‘S’ Sticker of the Samsung phone sold, Sales Date & Store Name need to be pasted in the Samsung S.T.A.R IMEI logbook and you will share the Samsung S.T.A.R IMEI logbook sheets with us on a weekly basis.

7.        Additionally Samsung will also award bonus Points based on the (1) Your store should maintain all the Samsung mobile phones display as per the standards recommended by Samsung field managers. (2) Your store should maintain significant display share of Samsung mobile phones.

8.        Points will not be awarded if the same IMEI Numbers are shared previously. If the same IMEI number is shared by two different members, the Points will be awarded to the first member who shared with us.

9.        Certain Samsung mobile phone models are excluded from earning Points and from redeeming cash or no cash rewards. These models are not included in the monthly Samsung S.T.A.R earning table which is with your store through our Samsung field force managers. Samsung S.T.A.R earning table will list out selected Samsung mobile phones models and their respective earning Points.

10.      Samsung reserves the right to amend the Samsung S.T.A.R earning table from time to time.

11.      We reserve the right to either increase or decrease the number of Points accrued on qualifying sales, or to change how Points are accrued, from time to time and at our sole discretion, and we will notify you of any changes we make by updating the Terms on the Website.

12.      At any point of time you will not be able to redeem 10% of the Points accrued as a security deposit. The same can be redeemed only upon withdrawing your membership from the Program.

13.      All the Points accumulated in the program will have one year validity and can be redeemed at any point of time for non-cash rewards. Cash awards can be redeemed once every calendar month.

14.      You can check your Points balance by calling UAE +971558078760, Kuwait +9655122060 or emailing helpdesk@samsungstars.com, help desk officer or by logging in online at www.samsungstars.com.

15.      Every month we will calculate the number of Points that you have accrued. If you have earned enough Points, we will award you with cash or non-cash rewards.

16.      We will send you any non-cash rewards through our Samsung Field Managers, within a reasonable period following every calculation period. We will send all vouchers to your store’s recent address that you have provided to us. It is your responsibility to ensure that we have the correct address. We are not responsible for vouchers once delivered to the provided address and we are not responsible for delayed or undeliverable mail. All the cash rewards will be transferred directly to the member’s bank account within a reasonable period following every calculation period.

17.      If your membership is cancelled for reason related to fraudulent sales of Samsung mobile phones, your Points will also be cancelled and no rewards, or any other financial or other benefit, will be given against your membership.

18.       You cannot transfer Points to another person, including any Program member.

19.      By agreeing to these Terms on our Website or the Application Form, you consent that we may process personal data that we collect from you in accordance with these Terms.

          Samsung may use your personal data that you supply to us on enrolment to the Program (such as your name,  address, contact details etc.), together with any information relating to your transactions and participation in the Program for the purposes of:  (1)administering the Program; (2)statistical analysis; (3)sending you news of our special events, offers, promotions and magazines either by post, email, SMS or through any social network; (4)market research

20.      You can, at any time after you have consented to receive information set out in clause 20, opt-out of receiving any and all such information by contacting: +971 55 807 8760, by emailing helpdesk@samsungstars.com, by asking help desk officer or email helpdesk@samsungstars.com or by logging in online at www.samsungstars.com.

21.      Samsung will only share your details with companies within the group, and businesses that assist with the operation of the Program, such as external IT suppliers. Samsung will not share your details with any other third parties without your explicit prior written consent.

22.      We reserve the right to amend or terminate the Program at our sole discretion. We reserve the right to vary or amend these Terms from time to time, at our sole discretion. We shall notify you of any changes to the Program and/or the Terms on our Website.

23.      These Terms shall be governed by laws of the United Arab Emirates and the courts of United Arab Emirates shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.
